These Terms of Service are an agreement between West Coast Ag Connection, LLC, an Oregon limited liability company (“Go Find a Farmer”, “we”, or “our”), and you (“you” or “your”). These Terms of Service govern your access to or use of the Go Find a Farmer service, including its various websites, applications, SMS, APIs, and email notifications (“Service”), and any information, data, text, graphics, photos, documents, forms, templates, profiles, or other materials uploaded, downloaded, or appearing on the Service (“Content”). By accessing or using the Service, you agree to be bound by the Terms of Service, including our Privacy Policy (“Terms”). These Terms affect your legal rights and obligations. If you do not agree to be bound by all of these Terms, do not access or use the Service.
Please note that these Terms contain an arbitration clause and class action waiver. By agreeing to the Terms, you agree to resolve all disputes through binding individual arbitration, which means that you waive any right to have those disputes decided by a judge or jury and that you waive your right to participate in class actions, class arbitrations, or representative actions.
We reserve the right to update or modify the Terms at any time and will notify you of any update or modification. Your use of the Service following any update or modification constitutes your agreement to follow and be bound by the new Terms. For this reason, we encourage you to review these Terms whenever you use the Service.
We reserve the right in our sole discretion and without prior notice or liability to you, to: (i) modify or stop providing the Service or any part of the Service to you or to users generally; (ii) remove or refuse to distribute any Content on the Service; (iii) suspend or terminate users.
The Service contains links to other websites that are not owned or operated by Go Find a Farmer. These linked sites are for your convenience and you access them at your own risk. We have no responsibility or liability for these websites and are not responsible for the content of such websites. Your use of such websites is subject to the terms of use applicable to each website, including any purchases made from such websites.
You understand that any review of information or data provided by you to Go Find a Farmer is limited to completeness, spelling, and internal consistency. To the best of your knowledge, you have provided complete and accurate information to Go Find a Farmer and have obtained all third-party consents required for your order.

If you purchase a Farm Membership, these payment terms apply to your Membership purchase and you agree to them. You must provide payment to access the Service and Content. Your right to use the Service is contingent upon our receipt of your payment for the Service. If payment cannot be charged to your credit card or if a charge is refunded for any reason, we reserve the right to immediately either suspend or terminate your access and account. We reserve the right to change any fees that we charge, or to institute new or additional fees, at any time in our discretion.
5.1. Third Party Processor. We do not process payments for the Service. Payments are processed by the third-party service Stripe. Stripe's terms of service, privacy policy, or other terms govern your relationship with them and their use of your personal information. You can find such terms on Stripe's website: https://www.stripe.com. You agree that we are not liable for any loss or claim that you may have against Stripe and release us from any claims or liability related to your agreement with Stripe.
The price stated for the Farm Membership excludes all applicable taxes and currency exchange settlements, unless stated otherwise. We may suspend or cancel your Farm Membership if we do not receive an on time, full payment. Suspension or cancellation of the Membership for non-payment will result in removal of your farm from gofindafarmer.com within 14 days.
You may use the Service only if you can form a binding contract with Go Find a Farmer and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. If you are accepting these Terms and using the Service on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so. You may use the Service only in compliance with these Terms and all applicable local, state, national, and international laws, rules and regulations.
7.1. Your Account. You must create an account with Go Find a Farmer to use the Service. You agree to provide and maintain true, accurate, current, and complete information about you. Registration data and certain other information about you are governed by our Privacy Policy. You are responsible for maintaining the confidentiality of your password and account and are solely responsible for any activities that occur under your password or account. You agree to immediately notify us of any unauthorized use of your password or account or any other breach of security.
7.2. Your Billing Account. To pay the charges for a Farm Membership, you will be asked to provide a payment method at the time you sign up. By providing Go Find a Farmer with a payment method, you (i) represent that you are authorized to use the payment method you provided and that any payment information you provide is true and accurate; (ii) authorize Go Find a Farmer to charge you for the Membership. You can access and change your billing information and payment method through your account if needed. If you have trouble signing into your account, please contact sheri@gofindafarmer.com. You agree to promptly update your account and other information, including your email address and payment method details, so we can complete your transactions and contact you as needed in connection with your membership. Your payment will be charged yearly unless you indicate otherwise.
7.3. Privacy Policy. Any information that you or other users provide to Go Find a Farmer is subject to our Privacy Policy, which governs our collection and use of your information. You understand that through your use of the Service you consent to the collection and use of this information as set forth in the Privacy Policy.
When you purchase a Farm Membership it will be charged to your payment method on an annual basis (365 Day Period). You agree that you are authorizing recurring payments until the subscription for that Farm Membership is terminated by you or by Go Find a Farmer. You must cancel your Membership before the next billing date to stop being charged. By joining Go Find a Farmer, you are authorizing Go Find a Farmer to store your payment details and process such payments as either electronic debits or fund transfers, or as electronic drafts from your designated account (for Automated Clearing House or similar payments), or as charges to your designated account (for credit card or similar payments) (collectively, "Electronic Payments”). If any payment is returned unpaid or if any credit card or similar transaction is rejected or denied, Go Find a Farmer or its service providers reserve the right to collect any applicable insufficient funds fee and process any such payment as an Electronic Payment.
Unless otherwise provided by law or by a particular offer, all purchases are final and non-refundable. If you believe that Go Find a Farmer has charged you in error, you must contact us within 90 days of such charge. No refunds will be given for any charges more than 90 days old. We reserve the right to issue refunds or credits at our sole discretion. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future. This refund policy does not affect any statutory rights that may apply.
You may cancel your Membership at any time, with or without cause. Cancelling paid Membership stops future charges to continue the Membership. To cancel a Service, email sheri@gofindafarmer.com to request the cancellation. If you cancel, your access to the Membership ends at the end of your current Membership period. If your Membership is cancelled prior to the expiration of the subscription period and you would like to remove your Farm Profile from gofindafarmer.com, please email sheri@gofindafarmer.com to make the request.
From time to time, Go Find a Farmer may offer promotional rates for Farm Memberships. These rates only apply for a period of one (1) year, or 365 days, after which the Membership will renew at the current rate for future subscriptions.
If we owe you a payment, then you agree to timely and accurately provide us with any information we need to get that payment to you. You are responsible for any taxes and charges you may incur as a result of this payment to you. If you receive a payment in error, we may reverse or require return of the payment. You agree to cooperate with us in our efforts to do this.
EXCEPT AS PROHIBITED BY LAW, YOU WILL HOLD GO FIND A FARMER AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS HARMLESS FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGE, HOWEVER IT ARISES (INCLUDING ATTORNEYS’ FEES AND ALL RELATED COSTS AND EXPENSES OF LITIGATION AND ARBITRATION, OR AT TRIAL OR ON APPEAL, IF ANY, WHETHER OR NOT LITIGATION OR ARBITRATION IS INSTITUTED), WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTION, OR ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, INCLUDING WITHOUT LIMITATION ANY CLAIM FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM THIS AGREEMENT AND ANY VIOLATION BY ME OF ANY FEDERAL, STATE, OR LOCAL LAWS, STATUTES, RULES, OR REGULATIONS, EVEN IF GO FIND A FARMER HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS PROHIBITED BY LAW, IF THERE IS LIABILITY FOUND ON THE PART OF GO FIND A FARMER, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE PRIOR LIMITATION OR EXCLUSION MAY NOT APPLY TO ME. THIS PARAGRAPH DOES NOT APPLY TO NORTH CAROLINA CONSUMERS.
Except as prohibited by law, you will indemnify Go Find a Farmer and its owners, officers, directors, employees agents, and representatives (each an “Indemnified Party”) against any claims, actions, damages, liabilities, losses, or costs, including attorneys’ fees, litigation or arbitration costs, and costs incurred in the settlement or avoidance of any such claim, incurred by or asserted against any Indemnified Party resulting from or arising in connection with: (i) your access to or use of the Service, or (iii) any breach or alleged breach by you of any of your representations, warranties, covenants, or obligations under these Terms.
You may terminate these Terms at any time by deactivating your accounts and discontinuing your use of the Service. If you stop using the Service without deactivating your accounts, we may deactivate your accounts due to prolonged inactivity. We may suspend or terminate your accounts or cease providing you with all or part of the Service at any time.
Go Find a Farmer strives to provide access to the Service and Content in accordance with the Americans With Disabilities Act (“ADA”) and similar state statutes. If you feel the Service or Content the ADA or other statutes, please contact us immediately with your concerns at:

These Terms constitute the entire agreement between the parties with respect to the Service. Except as provided in these Terms, no term or condition of the Terms may be amended or deemed waived, except by a writing signed by the parties that refers to the Terms. If any term or part of a term of the Terms is invalid, illegal, or unenforceable, the rest of the Terms will remain in effect. These Terms will be governed by and construed in accordance with the laws of the state of Oregon, without regard to conflict of laws principles. Any claim or arbitration arising out of these Terms, including tort claims, must be resolved in Oregon.
BY USING GO FIND A FARMER SERVICE OR ACCESSING THE GO FIND A FARMER SITE OR APPLICATIONS, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE AND AGREE TO BE BOUND BY THEM.
